Welcome to East Bay Online Tutoring. By accessing our website (eastbayonlinetutoring.com) and using our tutoring services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before using our services.
1. Agreement to Terms
By booking a tutoring session or purchasing a package through our website, you agree to these Terms and Conditions, our Privacy Policy, and our Cancellation Policy. If you do not agree with any part of these terms, please do not use our services.
2. Services Provided
East Bay Online Tutoring provides personalized online tutoring services for students from Transitional Kindergarten (TK) through college level. Services include:
• One-on-one tutoring sessions
• Homework help
• Test preparation
• Subject-specific instruction
• Study skills coaching
All sessions are conducted online via video conferencing platforms (Google Meet or Zoom).
3. Eligibility
• Students under the age of 18 must have parental or guardian consent to use our services
• Parents or guardians are responsible for booking sessions on behalf of minors
• You must provide accurate contact and payment information when booking
4. Booking and Scheduling (continued)
Session Booking: • Sessions must be booked through our website booking system • You will receive a confirmation email with the session date, time, and video conference link • Sessions are 60 minutes in duration unless otherwise specified • You must have a stable internet connection, computer or tablet, and access to video conferencing software
Availability: • Our tutoring hours are Monday-Friday 7:00 PM - 9:00 PM and Saturday 10:00 AM - 4:00 PM • We reserve the right to modify our availability with reasonable notice • Sessions must be booked at least 3 hours in advance
5. Payment Terms
Pricing: • Single sessions are $65 per hour • Package deals are available at discounted rates (4, 8, or 12 sessions) • All prices are in US dollars • Prices are subject to change with 30 days' notice
Payment Methods: • We accept credit/debit cards, Apple Pay, Google Pay, PayPal, and other payment methods through Wix Payments • Payment is required at the time of booking • All sales are final once the first session is completed
Packages: • Session packages are valid for 180 days (6 months) from the date of purchase • Unused sessions expire after 180 days and are non-refundable • Packages are non-transferable to other individuals
6. Cancellation and Rescheduling Policy
Cancellations: • Sessions may be cancelled or rescheduled up to 24 hours before the scheduled start time • Cancellations made less than 24 hours in advance will forfeit that session • To cancel, contact us at support@eastbayonlinetutoring.com or through your booking dashboard
Rescheduling: • Sessions may be rescheduled up to 24 hours in advance at no charge • Rescheduling requests made less than 24 hours in advance are subject to availability and may result in forfeiture of the session
No-Shows: • If you fail to join a scheduled session without prior cancellation, the session will be marked as complete and cannot be refunded or rescheduled
Tutor Cancellations: • If we must cancel a session, you will receive full credit for that session • We will make reasonable efforts to reschedule at a mutually convenient time
7. Refund Policy
• Single sessions are non-refundable once completed • Session packages are non-refundable after the first session has been completed • If you are unsatisfied before completing your first session, contact us within 24 hours for a potential refund consideration • Refunds are issued to the original payment method within 5-10 business days
8. Conduct and Expectations
Student/Client Responsibilities: • Arrive on time for scheduled sessions • Come prepared with relevant materials (textbooks, assignments, notes) • Treat the tutor with respect and courtesy • Participate actively in sessions • Complete any assigned practice work between sessions
Tutor Responsibilities: • Arrive on time and prepared for sessions • Provide quality, personalized instruction • Maintain a professional and respectful environment • Protect student privacy and confidentiality
Prohibited Conduct: • Harassment, discrimination, or abusive behavior of any kind • Sharing of inappropriate content during sessions • Recording sessions without prior written consent • Sharing login credentials or session links with unauthorized individuals
We reserve the right to terminate services immediately for any violation of conduct policies, with no refund.
9. Academic Integrity
• Our tutoring services are designed to help students learn and understand material • We do not complete assignments, write papers, or take tests on behalf of students • Students are responsible for submitting their own work and following their school's academic integrity policies • We encourage honest learning and ethical academic practices
10. Limitation of Liability
• East Bay Online Tutoring provides educational support services but does not guarantee specific academic outcomes or grade improvements • We are not responsible for technical issues beyond our control (internet outages, platform failures, device malfunctions) • We are not liable for any indirect, incidental, or consequential damages arising from use of our services • Our total liability is limited to the amount paid for the specific session or package in question
11. Intellectual Property
• All materials, content, and resources provided during tutoring sessions remain the property of East Bay Online Tutoring unless otherwise stated • You may not reproduce, distribute, or sell any proprietary materials without written permission • Student work and submissions remain the property of the student
12. Privacy and Data Protection
• We collect and use personal information as described in our Privacy Policy • We do not sell or share your personal information with third parties except as necessary to provide our services (payment processing, video conferencing) • Session content is confidential and will not be shared without consent • For full details, please review our Privacy Policy
13. Parental Consent for Minors
• For students under 18, a parent or legal guardian must:
Provide consent for tutoring services
Create and manage the booking account
Be responsible for payment and communication • Parents may request access to session information and student progress at any time
14. Video Conferencing and Recording
• Sessions are conducted via Google Meet or Zoom • Sessions are not recorded unless explicitly agreed upon by both parties in advance • You may not record sessions without prior written consent • Video must be enabled during sessions for effective tutoring
15. Communication
• Official communication will be sent to the email address provided during booking • You are responsible for checking your email regularly for session confirmations, reminders, and updates • We will respond to inquiries within 24-48 hours during business days
16. Modifications to Terms
• We reserve the right to modify these Terms and Conditions at any time • Changes will be posted on this page with an updated effective date • Continued use of our services after changes constitutes acceptance of the modified terms • We will make reasonable efforts to notify users of significant changes
17. Modifications to Services
• We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice • Pricing, availability, and service offerings may change • Active packages purchased before changes will be honored under original terms
18. Termination
By You: • You may stop using our services at any time • Unused sessions in packages are subject to our refund policy
By Us: • We reserve the right to refuse or terminate service for:
Violation of these terms
Inappropriate conduct
Non-payment
Fraudulent activity • Termination does not entitle you to a refund for completed sessions
19. Disclaimer of Warranties
• Services are provided "as is" without warranties of any kind • We do not guarantee specific academic results, grade improvements, or test scores • We make no warranties regarding uninterrupted or error-free service • Technical issues may occasionally affect service delivery
20. Indemnification
You agree to indemnify and hold harmless East Bay Online Tutoring, its owner, and affiliates from any claims, damages, or expenses arising from: • Your use of our services • Your violation of these terms • Your violation of any third-party rights
21. Governing Law
These Terms and Conditions are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Alameda County, California.
22. Dispute Resolution
• Any disputes arising from these terms or use of our services should first be addressed through direct communication with us • If resolution cannot be reached, disputes may be submitted to mediation before pursuing legal action • You agree to attempt good-faith resolution before initiating legal proceedings
23. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
24. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and East Bay Online Tutoring regarding use of our services.
